Terms of Service

These Terms of Service ("Terms") are an agreement between you and FlowState AI ("we," "us") for your use of VibeCoder U (the "App") and any VibeCoder U membership. By using the App or buying a membership, you agree to these Terms. If you don't agree, please don't use the App.

1. Eligibility

You must be at least 18 years old, or have a parent or guardian's permission, to buy a membership. A parent or guardian who allows a minor to purchase is responsible for the purchase and the minor's use.

2. What VibeCoder U is

VibeCoder U is an educational product that teaches how to plan, build, and verify software with AI tools. It provides lessons, build blueprints, prompts, scripts, and checklists. It is not a guarantee that any project will work, pass a security review, or earn money.

3. Accounts and memberships

• You need a free account to buy a membership. Give accurate information and keep your password private. You're responsible for activity on your account.
• Your account and membership are for one person and are not transferable. Do not share your login. We may suspend accounts that are shared or misused.
• Pro access is tied to your account and works on any device where you sign in. It turns on automatically after Stripe confirms your payment and turns off automatically when a subscription ends or a payment is refunded.

4. Payments, renewals, and cancellation

• Payments are processed securely by Stripe. Prices are set in U.S. dollars. At checkout, Stripe may show customers outside the U.S. an equivalent amount in their local currency. Applicable taxes may be added.
• Monthly memberships renew automatically every month and your payment method is charged until you cancel. You can cancel anytime by emailing ceo.flowstateai@gmail.com. Cancellation stops future charges, and you keep access through the end of the period you already paid for.
• Lifetime memberships are a one-time payment for Pro access for as long as we offer VibeCoder U.
• We may change prices for future purchases. If we change the price of an active monthly membership, we'll email you at least 14 days before the new price applies, and you can cancel before then.

5. Refunds

Refunds are covered by our Refund Policy, which is part of these Terms.

6. AI features

Some features use Claude, an AI model made by Anthropic. AI-generated content can be incomplete or wrong. You are responsible for reviewing and testing everything before you use it, deploy it, or deliver it to a client. AI features have fair-use limits to prevent abuse, depend on third-party services, and may change or be unavailable at times.

7. Ownership and license

• What you build is yours. You own the prompts and scripts you generate and the software you build with them, and you may use them for yourself or your clients, including for pay.
• The VibeCoder U App, lessons, blueprints, design, and branding belong to FlowState AI. You may not copy, resell, republish, or redistribute VibeCoder U's content as your own course, template pack, or competing product.

8. Acceptable use

Don't use VibeCoder U to build malware, phishing or look-alike sites, spam tools, or anything illegal or harmful; don't attempt to bypass access controls; and don't interfere with the App's operation.

9. Third-party services

VibeCoder U refers to third-party tools such as Replit, Lovable, Bolt, v0, Cursor, Stripe, and Claude. We are not affiliated with or endorsed by them, and their names are trademarks of their owners. Your use of those services is governed by their own terms.

10. No professional advice

VibeCoder U is educational. Nothing in it is legal, tax, financial, security, or compliance advice. For projects involving health data, payments, children's data, or other regulated areas, consult a qualified professional.

11. Disclaimer of warranties

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FLOWSTATE AI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE APP OR ANYTHING YOU BUILD WITH IT. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some places don't allow these limits, so they may not fully apply to you.

13. Indemnification

You agree to defend and hold harmless FlowState AI from claims arising out of software or content you build, deploy, or deliver to others using VibeCoder U, or your violation of these Terms.

14. Ending access

You can stop using VibeCoder U at any time. You can delete your account at any time from your account page. We may suspend or end access for violations of these Terms, such as sharing an account. Sections 7 and 10 through 15 survive after access ends.

15. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at ceo.flowstateai@gmail.com and try to resolve it informally for at least 30 days. Any claim that isn't resolved will be brought in the state or federal courts located in Texas, and both parties consent to that jurisdiction.

16. Changes to these Terms

We may update these Terms. We'll change the effective date, and for significant changes we'll notify members by email. Continuing to use the App after changes take effect means you accept them.
